Fairways Architectural Control Procedures & Responsibilities
HOMEOWNER TO-DOs:
- Provides 30-day notice to ACC via the Architectural Control Request Form
- Notice must include written detailed plans of any additions, improvements or modifications as described in FHOA Covenants, Section 8 and 8.1 and applicable restrictions mentioned in Section 13.
- Agrees to meet a member(s) of the ACC on the affected property to review the plan if the ACC requests such a visit.
- Agrees to provide additional detail and or design information requested by the ACC
- Provides (when required) evidence of necessary permitting to ACC before work begins.
ARCHITECTURE CONTROL COMMITTEE TO-DOs:
- Receive homeowner notices and plans (a 30-day clock starts upon receipt of final details/plans as required “specified” by the ACC).
- Visit the homeowner on their property as soon as possible to review plans.
- Assess community aesthetics, potential construction impacts and compliance with existing ACC Guidelines along with Sections 8 and 13 of the Covenants. Discuss any potential concerns with the owner and seek understanding of next steps to move the request to the board if, at the discretion of the ACC there are questions or concerns on which the BOD should have the final say.
- Manage timely approval for projects which are in obvious compliance with the Covenant, Sect. 8 & ACC Guidelines and not affecting third parties.
- Set up meeting with FHOA Board to review plans, and make recommendations when there are community architectural harmony and or potential construction impacts related to common property or third-party properties. The ACC Chair can sign off on any request that, in the Committee's judgment, does not need BOD review & approval.
BOARD OF DIRECTORS TO-DOs:
- Upon the ACC's request, FHOA Board reviews plans, ACC recommendations and assesses the immediate and long-term impact on properties and the community at large.
- If construction or landscaping activities might affect Common or third party properties, the Board will determine if a refundable deposit is appropriate to cover potential damages. (See FHOA Covenants, Section 8.)
- The FHOA Board:
- Approves plan as is
- Approves with contingencies or restrictions
- Disapproves
- FHOA Board member signs the “Architectural Request Form” and the ACC Chair provides results to the Homeowner.
